- Check each carefully
Continuous Employment

- Same employer throughout

The Qualifying Week
What It Is
The qualifying week (QW) is:
- The 15th week before your expected week of childbirth (EWC)
- Starts on a Sunday
- Critical date for eligibility
Calculating the Qualifying Week
| Step | Action |
|---|---|
| 1 | Find your due date |
| 2 | Find the Sunday of that week (EWC) |
| 3 | Count back 15 weeks |
| 4 | That's your qualifying week |
Example
If due date is 15 May 2025:
- EWC starts Sunday 11 May 2025
- Count back 15 weeks
- QW starts Sunday 26 January 2025
- Must have 26 weeks by 1 February 2025
Earnings Requirement
Lower Earnings Limit (LEL)
You must earn at least:
- £123 per week on average (2024-25)
- Calculated over 8-week "relevant period"
- Gross earnings (before tax)
The Relevant Period
| When Calculated | 8 Weeks |
|---|---|
| For SMP purposes | Up to and including qualifying week |
| What's counted | Gross earnings |
| Average needed | £123/week |
Variable Earnings
If earnings vary:
- Total gross pay over 8 weeks
- Divide by 8
- Must reach £123
Includes
| Included | Excluded |
|---|---|
| Basic pay | Benefits in kind |
| Overtime | Expenses |
| Commission | Statutory payments |
| Bonus (if earned) |
Still Employed Requirement
Into Qualifying Week
You must be employed:
- At some point in qualifying week
- Doesn't have to be whole week
- Can leave after QW and still qualify
After Qualifying Week
| Situation | SMP? |
|---|---|
| Stay employed | Yes |
| Leave after QW | Yes (if otherwise qualify) |
| Dismissed after QW | May still qualify |
| Leave before QW | No |
